Welcome to Jelly Ball (“Jelly Ball,” “we,” “us,” or “our”), a game operated by Jellyball LLC (“Company”) at jellyball.io. By playing, watching, creating an account, or otherwise using our website and related services (collectively, the “Service”), or by clicking “I Agree” during sign-up, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

Jelly Ball runs on the same accounts and servers as our other site, Chideout (chideout.com). Chideout is for adults only and has its own Terms of Service, which apply whenever you use chideout.com.

IMPORTANT NOTICE: SECTION 13 OF THESE TERMS CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. IF YOU ARE UNDER 18, PLEASE READ THESE TERMS WITH YOUR PARENT OR GUARDIAN.

1. Who Can Play

1. All Ages: Jelly Ball is open to players of every age. You can play without an account (see Section 2). You need an account to post levels, upload pictures, chat, add friends, or use Cred.
2. Under 13: If you are under 13, you need your parent or guardian’s permission to create an account. When you sign up, we ask for your parent’s email address and send them a link explaining what we collect. Your account stays locked until your parent approves it. If your parent declines, or does not answer within 14 days, the account is deleted. Parents can withdraw their permission and delete the account at any time (see our Privacy Policy).
3. Ages 13 to 17: If you are 13 to 17, you may create an account only if your parent or guardian has reviewed these Terms and agrees to them for you.
4. Protections for Players Under 18: Accounts that belong to anyone under 18 automatically:
   • cannot bet Cred or stake Cred in Odds & Bets;
   • can chat and send direct messages only with friends, and cannot start or join public chats;
   • are hidden from people search and friend suggestions;
   • appear as “Jelly player,” without a username or profile photo, on matches, leaderboards, ghosts, and races; and
   • cannot use chideout.com.
5. Tell the Truth About Your Age: You must enter your real date of birth. We may suspend or delete any account that we believe was created with a false date of birth.
6. Parents and Guardians: If you allow a child to use Jelly Ball, you agree to these Terms on the child’s behalf and are responsible for the child’s use of the Service.

2. Playing Without an Account (Guest Players)

1. When you start or join a match or race without signing in, we create a temporary guest player for you with a random name such as “Guest 48213.” Guest players can play matches, race, and watch. They cannot post, upload pictures, chat, add friends, or use Cred.
2. Guest players are treated as players under 18, and their runs do not appear on leaderboards.
3. A guest player is deleted automatically after 7 days without use. If you want to keep your progress, create an account.
4. To protect the game from attacks and abuse, we limit how many guest players can be created from the same network, and we may refuse guest play from networks or devices that were banned.

3. Accounts & Security

1. Signing In: You can create an account with an email address and password, or with any other sign-in method we offer. You may only use email addresses, phone numbers, and third-party accounts that you own and control.
2. Keep It Safe: You are responsible for everything that happens on your account. Keep your password private, and tell us right away at [email protected] if you think someone else has used your account.
3. One Person, One Account: You may not create or use multiple accounts to farm Cred, manipulate bets, leaderboards, or votes, or get around a suspension or ban.

4. Your Content

1. What Counts as Your Content: “User Content” means anything you submit to Jelly Ball, including levels, pictures you upload for levels, arenas, and balls, hoops and boundaries you place, titles, posts, comments, chat messages, and your recorded runs and throws.
2. Your Pictures: Only upload pictures that you took or have the right to use. Do not upload pictures that show other people without their permission, or that show personal information such as addresses, phone numbers, license plates, or ID cards. Every uploaded picture is checked automatically before it can be used, and pictures that break these Terms are refused or removed.
3. What Is Public: Published levels, public matches, leaderboards, ghost replays, and races can be viewed by anyone, including people without an account. Pages and share images for public matches show players’ display names, usernames, and scores, and may appear in search engines. Players under 18 and guest players are never shown by username.
4. License to Us: You keep ownership of your User Content. By submitting it, you give Jellyball LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, process, adapt, display, and distribute it to run, improve, and promote the Service. For example, we may turn your picture into a level, replay your runs as ghosts for other players, and create share images of your matches. This license ends when your User Content is deleted from the Service, except for copies kept as described in our Privacy Policy and content that other players have already copied into their own matches or replays.
5. Your Responsibility: Under 47 U.S.C. § 230, we are not the publisher or speaker of User Content submitted by players. You are solely responsible for the User Content you submit.

5. Rules of Play

You may not:

• Cheat: use bots, scripts, macros, or modified clients; send fake or altered inputs, runs, or throws; tamper with the game simulation or replays; or exploit bugs to gain an advantage. If you find a bug, please report it to us instead.
• Harass or Bully: threaten, bully, stalk, or harass anyone, or encourage others to do so.
• Endanger Kids: post sexual content of any kind; contact a minor for a sexual or romantic purpose; ask a minor for personal information, pictures, or to move the conversation off Jelly Ball; or otherwise put a child at risk. We report apparent child exploitation to the National Center for Missing & Exploited Children and to law enforcement.
• Share Personal Information: post anyone’s real full name, address, school, phone number, email address, or other private information, including your own if you are under 18.
• Post Harmful or Illegal Content: post content that is hateful, violent, graphic, sexually explicit, defamatory, or illegal, or that infringes anyone’s copyright, trademark, or other rights.
• Spam or Scam: flood the Service with repetitive, commercial, or automated content, or try to trick other players out of their accounts or Cred.
• Attack the Service: overload, probe, scrape, or disrupt the Service; get around our rate limits, spam filters, or other protections (for example by rotating IP addresses or using proxies); or access accounts or data that aren’t yours.
• Impersonate: pretend to be another person, a Jelly Ball moderator, or Jellyball LLC.

6. Cred, Bets & Odds

1. Cred Has No Cash Value: “Cred” is a reputation score earned by playing and taking part in the community. Cred is not money, a currency, or property. Jelly Ball does not sell Cred, and Cred cannot be redeemed for cash, prizes, or anything of value, or sold or transferred outside the Service. We may change, reset, or discontinue Cred at any time.
2. Betting on Jelly Fights: Players 18 and older with an account may bet Cred on matches for fun. Bets go into a shared pool, and when the match ends the people who backed the winner split the pool in proportion to their bets. We currently take no cut. Bets stay open until the final throw. Once placed, a bet cannot be changed or taken back, only added to. If a match is cancelled, or nobody backed the winner, everyone gets their Cred back.
3. Who Can’t Bet: Players under 18, guest players, and the two players in a match cannot bet on it.
4. Odds & Bets: Predictions in Odds & Bets are for fun and pay out nothing of value.
5. Fair Play: If we believe a match, bet, or prediction involved cheating, collusion, or multiple accounts, we may cancel it, reverse the Cred involved, and suspend the accounts.
6. Paid Features: Jelly Ball itself has no purchases. If you buy a paid feature through your account (such as a Reward on a post), that purchase is covered by the terms shown at checkout and Section 6 of the Chideout Terms of Service. Players under 18 must have a parent or guardian’s permission to make any purchase.

7. Moderation & Reporting

1. Our Right, Not Our Duty: We may remove or restrict any User Content, cancel any match or race, reset leaderboards, and suspend or terminate any account, at any time and for any reason, including content we find objectionable whether or not it is unlawful. We are not required to monitor, review, or pre-screen User Content, and leaving something up does not mean we endorse it.
2. Reporting: Use the in-app Report button on posts, comments, messages, and chats. To report a match, race, ball, player, or anything else, or if you don’t have an account, email [email protected] with a link or description and why it should be removed. We review reports promptly and, where the law requires, report content to the authorities.

8. Copyright Infringement (DMCA Takedown Policy)

In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we respond quickly to valid notices of copyright infringement. If you believe your copyrighted work appears on Jelly Ball without authorization, send our Designated Copyright Agent a written notice containing:

1. a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. identification of the copyrighted work claimed to have been infringed;
3. identification of the material on Jelly Ball (including the level, match, or post URL) and information reasonably sufficient to permit us to locate it;
4. your contact information (name, mailing address, telephone number, and email address);
5. a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-Notice: If your content was removed because of a copyright notice and you believe that was a mistake, you may send our Designated Agent a counter-notice that includes your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, your name, address and phone number, and your consent to the jurisdiction of the federal court for your district (or, if you are outside the US, any district where Jellyball LLC may be found). We may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complaining party tells us it has filed a lawsuit.

Repeat Infringers: We will, in appropriate circumstances, terminate the accounts of users who repeatedly infringe copyrights.

9. Changes to the Game

Jelly Ball is a game in active development. We may add, change, or remove features, levels, modes, and settings, rebalance gameplay, reset leaderboards or Cred, or pause the Service at any time. We are not responsible for lost progress, scores, or Cred.

10. Disclaimers of Warranties

THE SERVICE AND ALL CONTENT AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AUTOMATED SAFETY CHECKS WILL CATCH EVERY PROHIBITED PICTURE OR MESSAGE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JELLYBALL LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROGRESS, CRED, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY USER CONTENT POSTED BY OTHER PLAYERS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Jellyball LLC and its affiliates, officers, and employees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your violation of these Terms; or (c) your violation of anyone else’s rights.

13. Governing Law, Binding Arbitration & Class Action Waiver

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring qualifying claims in small claims court. YOU AND JELLYBALL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If you are under 18, your parent or guardian agrees to this Section on your behalf.

14. Changes to These Terms, Termination & Contact

1. Changes: We may update these Terms. When we do, we will update the version number and date above, and account holders will be asked to review and accept the new Terms before they continue. If you do not agree, you may stop using the Service and delete your account.
2. Termination: You may delete your account at any time from Account Settings. We may suspend or terminate accounts that violate these Terms.
3. Trademarks: Jelly Ball, the Jelly Ball logo, and Chideout are trademarks of Jellyball LLC. You may not use them in a way that suggests we sponsor or endorse you without our written permission.
